All photos/motives/recordings are original protected.
The total use and Copyright as well as all rights on negatives and recordings stay with the originator. Profit and Purchase from a photo includes the conditional Right/Copyright of use for the originator the recording in his advertisement, brochures, prospects and websites.

Should a original protected photo be given to a third such as for example Newspapers, Magazines or Publishing house or whatever to publishing uses or for advertisement purpose, then a consideralbe payment to a certain amount be payed to originator (in doubt insured supplier the photos).

By offence against the COPYRIGHT for example unallowed copying or use of original protected photos, allowes us to demand a compensation in a suitable amount and according to professional privilege.

Picture verification:
Publishing of photos only with title and naming of the Originator according to §13 UrhG as well as sending of an specimen copy. The image source proof is always required  at the respective picture.

Picture presentations:
Picture presentations are made available only on loan and one must send back.
Digital picture presentations have to be deleted after the use.
Storage at the user must be agreed on.

Fees/costs for the use of pictures:
After the customary to the market conditions for the use of pictures in the different medium areas.

Surcharges:
Surcharges refer to it at the time of the use's current basic fee of the respective use purpose.

• Refraining of the image source proof = plus 100% (Administration of justice, for example: LG Hamburg vom 20.11.87, Az 74 0 68/78, LG München I vom 23.4.91, Az.210 6247/89)

• Penalty for breach of contract at not approved use.: the fivefold fee (OLG FfM Az 11U 49/96(I/1), OLG Celle Az 13U 81/96 + 13U 139/96)
